1. Overview of Services

Design my Space UK provides remote interior design services, offering tailored digital design packages that include 2D Design boards, floor plans, product sourcing, and 3D visualisations. All services are delivered online, based on the information provided by the client.

2. Entire Agreement

These Terms of Service constitute the entire agreement between you and Design my Space UK for the use of the site and the design services and supersede any prior agreements.

3. Use of Website

3.1 Our website www.designmyspace.uk is intended for personal, non-commercial use.

3.2 We take reasonable steps to ensure the website is accurate and up-to-date, but we do not guarantee uninterrupted access or freedom from errors or viruses.

3.3 You may not reproduce, distribute, or commercially exploit any part of the website without written permission.

3.4 Any links to third-party websites are provided for convenience only. We are not responsible for the content or privacy practices of those sites.

3.5 We shall use our reasonable endeavours to ensure the site is kept secure at all times. However, we do not warrant that your information will not be used by a third party.

3.6 Any information obtained or downloaded by you shall be at your own risk and we do not warrant that such information will be free of viruses or other malware.

4. Client Responsibilities

To receive the best results, clients agree to:

• Provide accurate measurements, photographs, inspiration, and any other required information in a timely manner.

• Review and respond to design proposals and revisions within 7 days unless otherwise agreed.

• Confirm final designs and complete the project within the active service period.

We are not responsible for delays or design limitations caused by incomplete or inaccurate information.

5. Free Consultation

We offer a complimentary 30-minute consultation to discuss your design needs and recommend the most suitable package. This session is intended to determine scope and is not a design advice session.

6. Project Timelines

Design proposals are typically delivered within 2 weeks from the date all required materials have been submitted by the client. We aim to meet this timeframe consistently but reserve the right to extend the delivery schedule if needed.

Final design package completion is expected within 1–2 weeks after the proposal approval, unless otherwise agreed in writing.

Delays caused by a client’s lack of response or missing information may result in the project being paused or closed. If we do not hear from a client for a continuous period of 2 months, the project will be considered closed. Any reactivation of the project may be subject to additional fees.

7. Design Revisions

Each design package includes up to four rounds of revisions within the design timeframe. Revisions must be requested within the allotted time period (usually 2 weeks for proposals, 1 week for finalisation).

Revisions beyond the included number may be quoted and billed separately. Design my Space UK is under no obligation to provide additional revisions once the included rounds have been used.

8. Design Ownership & Usage

Clients receive a limited license to use the design materials provided for personal, non-commercial use in their home or property.

Design my Space UK retains copyright and intellectual property rights to all designs, layouts, illustrations, and documentation. These may not be reproduced, resold, or shared publicly without written permission.

If a client shares any photographs of their completed or partially completed space, these images may be used by Design my Space UK for portfolio or marketing purposes. Clients may opt out by contacting info@designmyspace.uk.

9. Use in Portfolio & Marketing

We reserve the right to feature completed or in-progress design work in our portfolio, social media, and marketing materials. Identifiable client information will never be disclosed.

10. Product Sourcing & Third Parties

We may recommend products from third-party suppliers. While we aim to suggest reputable vendors, we are not responsible for the availability, pricing, delivery, quality, or warranty of third-party products.

Clients are responsible for verifying all measurements, lead times, and compatibility before purchasing.

Clients are responsible for placing orders directly with the supplier and managing delivery, returns, and warranties.

11. Colour Accuracy & Visualisations

Colours shown in visuals and 2D design boards may vary depending on screen settings, lighting, and manufacturing differences. Final product colours and finishes may differ in person.

Visual representations are for conceptual purposes and may not reflect exact scale or detail. Clients must verify all aspects with their contractor before proceeding with any work.

12. No Reliance on Information

The content on the site is provided for general information only and is not intended to be advice on which you should rely. We advise that you obtain professional or specialist advice before taking any action based on the content of this site.

13. Modifications to Service or Terms

We reserve the right to modify our services or these Terms of Service at any time. Updated terms will be posted on our website. Continued use of our services constitutes acceptance of any changes.

14. Limitation of Liability

Nothing in these Terms of Service limits our liability for death or personal injury arising from our negligence, or any other liability that cannot be limited by law.

The use of the site is entirely at your own risk, to the extent that may be permitted by law, and we exclude all warranties and representations, whether express or implied, which may apply to our site or its contents.

15. Age Restrictions

No part of the service is directed to persons under the age of 18. If you are under 18 years of age, please do not use or access the service at any time or in any manner. By using our services, you confirm that you are at least 18 years old.

16. Construction, Structural Work, and Approvals

All visual materials, design proposals, and suggestions are intended for conceptual and space planning purposes only.

Design my Space UK does not provide architectural, structural, electrical, or engineering services. Any construction, renovation, lighting installation, joinery, or structural work must be carried out by licensed professionals who are solely responsible for ensuring compliance with local regulations, planning permissions, and safety standards.

Clients are responsible for obtaining any required permits or approvals before commencing any work.

17. Third-Party Products and Liability

We may include links to or suggestions for third-party products as part of our shopping list. While we aim to recommend quality sources, we do not guarantee the safety, performance, or suitability of any third-party items.

We are not liable for damage, injury, or loss resulting from the use of third-party products. Clients are responsible for checking product safety, installation instructions, and suitability before use.

18. Project Closure

If no communication is received from the client for a continuous period of 2 months, the project will be considered closed. Reactivation may incur additional charges.

19. Third-Party Links

19.1 Where our design services include a curated shopping list with links to third-party websites for the purchase of items, although we will always endeavour to select retailers that share our high standards, we are not responsible for the content, security, performance, practices, or policies of their websites and do not guarantee or warrant that they will be inoffensive, fit for purpose, or free of viruses or other malware.

19.2 Any purchase by you from a third-party retailer is made by way of a separate contract between you and the retailer. We are neither a party to such a contract nor an agent of you or the retailer.

19.3 While we will always endeavour to provide you with up-to-date cost estimates, we do not guarantee the price you may need to pay for third-party purchases.

20. Deliverables & File Format

We will provide the deliverables of your project via email to the address you provided when booking. Deliverables will typically be provided in Portable Document Format (PDF). We do not provide native working files such as CAD plans, SketchUp models, or spreadsheets used during the development of your design.

21. Description of Service Deliverables

The specific deliverables you receive will depend on the design package you have selected. Details of what is included in each package are outlined on our website. Deliverables may include digital 2D design boards, furniture layouts, 3D visualisations, shopping lists, and installation notes where relevant. All materials are provided digitally.

22. Legal Compliance

Clients are solely responsible for ensuring that any use of the design, items sourced, or changes to the property comply with applicable laws, building regulations, lease terms, or local authority rules. Design my Space UK is not liable for any violation of such requirements.

23. Privacy & Data

We take privacy seriously and process client information in line with our Privacy Policy. Any images, personal details, or documents shared during the project will be stored securely and used only for the purpose of providing design services unless you have given consent for other use. 24. Indemnity

You agree to indemnify and hold harmless Design my Space UK, its employees, contractors, and affiliates, against any third-party claims, losses, damages, or legal fees arising from your breach of these Terms or misuse of the services or website.

25. Severability

If any part of these Terms of Service is found to be invalid or unenforceable, the remaining sections will continue in full force. Where possible, any invalid term shall be interpreted to reflect the original intention as closely as permitted by law.

26. Third-Party Rights

These Terms of Service are between you and Design my Space UK. No third party shall have the right to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

27. Client Responsibility for Installation or Styling

Clients are responsible for the correct installation, assembly, or placement of items in their space. Design my Space UK is not liable for any damage, injury, or loss arising from the improper use, installation, or styling of recommended items.

28. Design Interpretation Disclaimer

While we aim to represent our designs as clearly as possible, digital visuals, 2D design boards, and 3D representations are for illustrative purposes only. Actual results may vary based on lighting, materials, and construction methods.

29. Service Availability Disclaimer

While we aim to deliver our services reliably, Design my Space UK reserves the right to temporarily suspend or delay services due to unforeseen events, including illness, technical issues, or circumstances beyond our control. Clients will be notified and kept updated in such cases.

30. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, labour disputes, or government actions.

31. Termination by Client

Clients may choose to terminate the service at any time by written notice. However, no refunds will be issued once the design process has begun. In certain cases, partial credit may be offered at our discretion for unused services.

32. Compliance with Laws and Regulations

Clients are solely responsible for ensuring that any implementation of our design proposals complies with all applicable local laws, planning permissions, building regulations, landlord requirements, and health and safety standards. Design my Space UK accepts no responsibility or liability for any fines, penalties, losses, or legal consequences arising from the use or execution of our designs in violation of such requirements.

33. Terms for Gifted Packages

Gift vouchers for design packages must be redeemed within 12 months of the purchase date. Once redeemed and design work begins, the same terms apply as for standard packages, including timelines, responsibilities, and limitations.

Gift recipients must provide required information in a timely manner. Projects not initiated within 2 months of redemption may be closed or subject to reactivation fees.

Gifted packages are non-refundable once redeemed.

34. Limitation of Liability (Supplementary Clause)

To the maximum extent permitted by law, Design my Space UK is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of our services or reliance on our designs.

We are not responsible for:

• Errors caused by inaccurate measurements or information provided by the client.

• Changes in product availability, pricing, or delivery by third-party suppliers.

• Unsatisfactory outcomes resulting from client changes or implementation errors.

All design schemes, proposals, packages, and associated materials provided by Design my Space UK are intended for visual inspiration and space planning purposes only. They are not construction documents. Any suggested joinery, built-in, or structural elements must be designed, built, and installed by a qualified contractor who will take full responsibility for compliance, safety, and structural integrity. Clients are solely responsible for obtaining any necessary permits, approvals, or consents required prior to commencing work. Clients must verify all design aspects with their contractor or tradesperson before implementation.

Our maximum liability, if any, is limited to the amount paid for the specific design package purchased.

35. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
